Terms and Conditions of Rental
1. The Parties
This Agreement is made between myself, the Owner of Les Arbres, Mr C Gaebler of 52b Madan Road, Westerham, Kent, TN16 1DX, England, and you the Party Leader, whose name and address is supplied with this booking. The Party Leader accepts these Terms and Conditions on behalf of the entire party.
2. Booking and Deposit
A booking is confirmed when the required booking details and 20% deposit have been received by the Owners at the above address. The booking must be made in writing, signed by the Party Leader, and sent by post to the Owner. A written receipt will be returned to you by post, signed by the Owner. All subsequent correspondence is usually by email.
3. Payment of Balance
At least a further 40% of the total rental cost must be paid and cleared not less than eight weeks prior to the start date of your holiday. If this further payment is not received by the due date, the property will be re-marketed for the booked dates and if a new booking is accepted, your booking will be cancelled and your deposit forfeited.
The last remaining 40% must be paid, cleared and visible in our bank account before your arrival at the property. As a last resort you may pay any outstanding or uncleared balance in cash on arrival. Keys will not be handed over if any balance is outstanding or uncleared.
4. Cancellation or Alteration
If you have to cancel your holiday for any reason, your 20% rental deposit will not be refunded. If notice of cancellation is given at least eight weeks prior to the holiday commencement date, you will not be liable to pay the balance of the rental. If notice of cancellation is received less than eight weeks prior to the commencement of the rental you will be liable for the entire outstanding balance of the rental. However, we will attempt to re-let the property and if we are successful we will refund you the proceeds of the new letting less any costs or discounts incurred. You are strongly advised to take out holiday insurance to include cancellation.
If you need to alter your holiday dates, we will try to help but reserve the right to treat the alteration as a cancellation and re-booking.
5. Arrival
The property will be available for occupancy from 4:00 pm on the day of arrival. The Owners or an agent will need to be on site for your arrival, so please inform us of your estimated time of arrival, and please contact us if you are delayed. We may ask for proof of identity of the party leader before handing over the keys.
6. Departure
The property must be vacated by 10.00 am on the day of departure in order to allow sufficient time for the changeover. The owner or agent may arrive from 9:00 am to begin servicing the pool and outdoor areas. The house must be left in a clean and tidy state. Any cleaning required may be charged against your security deposit.
7. Security Deposit
A refundable security deposit of £200 is required and must be paid and cleared into our bank before the start of the rental. This will be refunded in full within seven days of your departure unless there is a need to make a deduction. Such deductions may be in respect of, but are not limited to, missing items, breakages, stains, or other damage to the property or its contents, or additional cleaning if the property is left in an unreasonable state.
8. Reasonable Care
You are responsible for ensuring that your entire party take reasonable care of the property and its contents. You are liable for any losses from or damage to the property during your stay, however caused, reasonable wear and tear excluded. You are responsible for the full cost of any damages or breakages caused by any member of the party. Liability is not limited to the amount of the Security Deposit.
Smoking is strictly not permitted inside the property.
You must lock up at night and when you are out during the day.
You must comply with local laws and regulations, for example regarding the disposal of rubbish. The regulations regarding rubbish disposal are clearly set out in the visitors guide available at the property, or available in advance on request.
We ask that you respect the environment and the people of France. Recycle. Do not litter. Do not waste water or energy. Respect the countryside and the forest.
9. Occupancy
The property may only be occupied by the number of persons stated in the booking. Any amendments must be notified and agreed by the Owners in writing. The property may be occupied solely for the purposes of a holiday. This Agreement does not create any relationship of Landlord and Tenant. You are not entitled to any form of security of tenure as a result of this Agreement.
10. Swimming Pool
Use of the swimming pool is at your own risk. Children must be supervised at all times by an adult who must not be tired or drinking alcohol. No diving. You must not take any form of glass, crockery or utensils anywhere near the pool area (plastic items are provided). Proper swimming pool hygiene must be observed. You agree to read and comply with the precautions set out in the visitors guide at the property or available in advance on request. The swimming pool will be cleaned and maintained several times during your stay.
11. Noise and Nuisance
The property is in a normally quiet residential area, and we ask that you show reasonable consideration for the neighbours and other local residents at all times, but especially in the evenings and at night. As a rough guide, we suggest that after 9pm, raised voices would not be appropriate behaviour. Please be especially vigilant of children using the pool in the evening. Bathing and relaxing is fine, rowdy games are not.
12. Owner Access
The owners or their agent reserve the right to reasonable access to the property in order to carry out any maintenance which may be required, or if they have any reasonable grounds for concern. The owners will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.
13. Termination
The owners reserve the right to terminate your occupancy with immediate effect and without refund in the event of a serious breach of these Terms and Conditions.
14. Accidents
No responsibility is accepted for any accident, loss, damage or illness howsoever arising. You are strongly advised to take out holiday insurance to cover such events.
15. Non-Availability
If for any reason the property cannot be made available on the date booked, all rent paid in advance will be refunded in full, but there will be no further liability. We are not responsible for any travel cancellation costs, lost time, or any other additional costs whatsoever. You are strongly advised to take out holiday insurance to cover any such costs or claims.
16. Complaints or Problems
You must contact us immediately if any problem or cause for complaint arises, and allow us all reasonable opportunity to rectify the problem during your stay. We will not make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to us during the holiday rental period. The owners do not accept responsibility for events or persons outside their control.
17. Linen
Use of clean bed linen is included in the rental cost. Towels and beach towels are available at extra cost. All items must be left behind at the end of the rental. Any damage or irremovable stains will be charged against your security deposit. Our bath and hand towels must not be taken to the beach.
18. Gas and Electricity
Reasonable usage of gas, electricity and hot water is included in the rental price. Only low energy (LED or fluorescent) lights should be left on overnight, if necessary. The tumble dryer should not normally be used in warm, dry weather. Excessive or unnecessary energy use may incur a deduction from your deposit.
19. Directions
Detailed directions will be sent to you well before your arrival date.
20. Assistance
The owners (or an English speaking representative) will be available nearby during your stay and will offer assistance in any way they can. A mobile phone number will be available at the property. For non-emergencies, please send a text during daylight hours. In an emergency, you can text or call at any time of the day or night.
21. Jurisdiction
These Terms and Conditions are to be interpreted in accordance with English law and any dispute arising will be dealt with in England under English law.
